Welcome! We are the tooldi Creator team, building a new and innovative design ecosystem together with you. Amid technology that advances day by day — especially AI technology, which is exerting a powerful influence in the field of design — we provide this Generative AI Content Policy so that you may enjoy the tooldi design ecosystem more freely and safely.

This Policy applies to the use of all kinds of AI-related functions and content, including the "AI Drawing function," "tooldi AI Studio," and the "uploading of Generative AI Content" through the Creator Service provided within the tooldi Service. The Company operates this Policy in compliance with relevant laws and regulations, including the AI Framework Act (Act on the Development of Artificial Intelligence and Establishment of Trust). As this Policy may be updated from time to time, please be sure to review it.

2Purpose of the Policy

The tooldi design platform pays close attention to AI technology, which changes and advances by the moment. Where such functions align with the mission tooldi pursues, we will actively make these technologies available on the tooldi platform so that you may engage in better creative activities.

However, there exists a potential concern that the misuse of AI technology may give rise to new ethical problems in our society. tooldi strives to dispel such potential concerns by upholding its principles regarding AI technology within the design ecosystem, and to build a design ecosystem in which creation and AI technology coexist.

The principles that tooldi holds regarding AI technology are as follows.

• We value all the more the worth of the original works used as the subject of AI learning.
• We pursue the creation of AI content imbued with better intent and meaning.
• We respect the creativity of AI content creators.
• AI technology enriches the design ecosystem activities of Creators.
• For content in which AI has been used, we transparently indicate that fact so that users can clearly know whether it was AI-generated.

We implement this Policy in order to realize these values, and we ask for the keen interest and cooperation of all.

3Definition of Relevant Terms

• Generative AI Content: The collective body of content produced through the Company's own or third-party services that provide generative AI drawing functions.
• AI Drawing: A tool or function provided by the tooldi Service for the production of Generative AI Content.
• tooldi AI Studio: A tool or function within the tooldi Service that allows users to generate, transform, or reprocess elements, photos, templates, and the like by utilizing generative AI functions. Content generated or transformed through tooldi AI Studio is configured to be utilized within the tooldi Service.
• Prompt: The text directly written by the User in order to realize the AI Drawing and AI Studio functions provided by tooldi and thereby generate content.
• AI Metadata: Metadata information, such as tags, extracted by recognizing photos, images, and the like.
• AI Model: Among person-shaped Generative AI Content, the content selected and provided by the tooldi Service.
• Deepfake: Virtual information (such as video, image, or audio) created by using generative AI technology or the like to synthesize the face, body, voice, etc. of an actual person into another video, image, or audio, or to make something that did not actually happen appear as if it were true.
• AI-Generated Indication: Indicating the fact that content has been generated or transformed by generative AI, by means of a user-perceptible indication (such as a label or text) or a machine-readable indication (such as a watermark).

4Scope of Use of AI Content

Within the tooldi design ecosystem, AI Content is broadly used in two areas.

Use in Design Creation

The first scope of use is the application of AI Content to design creation. When you create designs using the Editor provided by this Service, you may utilize the AI Drawing and tooldi AI Studio functions to compose the desired components. You may also produce finished templates by utilizing the Generative AI Content already provided.

Use in the Creator Field

The second scope of use is the application of AI technology to the Creator ecosystem. You may upload Generative AI Content and provide it to the tooldi Service. Uploaded content is managed as Generative AI Content produced by the Creator, and you may carry out revenue-generating activities with such content.

5Attribution of Copyright and Use of AI Content

In order to clarify the rights relationships of Generative AI Content, thereby protecting creators while at the same time enabling stable operation of the Service, the following is established.

• Attribution of Copyright: The copyright in Generative AI Content generated or created by a User or Creator with a Prompt that they directly wrote, using the AI Drawing or tooldi AI Studio functions, belongs to the User (the owning account) who created it. The Company does not have such copyright assigned to it from the User.
• Limitation to Use Within the Service: Content generated or transformed through tooldi AI Studio is, by the nature of its functional configuration, utilized within the tooldi Service, and the User may use it in the manner and within the scope provided by the tooldi Service.
• License to the Company: The User grants the Company a non-exclusive license to use such content to the extent necessary for the provision, operation, display, and improvement of the functions of the Service and for the performance of obligations under this Policy. Content already distributed and in use within the Service may continue to be provided and maintained by the Company even after the termination of the User's activity, for the sake of service stability and the protection of other users' work.
• Maintenance of Original Contributor Identification Information: Even where elements, photos, templates, and the like of other Creators are transformed or reprocessed using tooldi AI Studio or other generative AI functions, the contributor identification information of the original work and the rights and revenue aggregation arising therefrom shall remain validly in effect. Even if the form or style has been changed by AI, the contributor status of the original content Creator and the related information shall not be deleted and shall be maintained identically.
• Relationship with Other Documents: Matters concerning the attribution of rights, revenue, and settlement of Creator Content, as well as the specific scope of the license, shall, together with this Policy, be governed by the Terms of Service, the Creator Terms and Conditions, and the Content License Policy.

6AI-Generated Indication

The Company and the User shall transparently indicate that content has involved the use of AI, so that users can clearly recognize this. (Indication obligation under the AI Framework Act (Act on the Development of Artificial Intelligence and Establishment of Trust).)

• Indication by the Company: For content generated or transformed by generative AI functions provided by the Company, such as AI Drawing and tooldi AI Studio, the Company shall indicate the fact that it was generated or transformed by generative AI by means of a user-perceptible indication (such as a label or text) or a machine-readable indication (such as a watermark).
• Clear Indication of Deepfakes: For outputs that raise concerns about adverse social effects, such as deepfakes, the Company shall indicate them in a manner that users can clearly recognize, taking into account the age of the users and other factors.
• User's Indication and Notice Obligation: When posting or sharing Generative AI Content or content that includes it (such as finished templates), the User must indicate that the output is one in which generative AI was used, so that it is not mistaken for a work created independently without the assistance of AI.
• Prohibition of Removing or Circumventing Indications: No one may, without legitimate grounds, remove or alter an AI-Generated Indication applied by the Company or another person, or engage in any act for the purpose of evading or circumventing its identification.

7Responsibilities, Obligations, and Rights of the Company and Users Regarding AI Content

In utilizing AI Content within the tooldi design platform, the responsibilities, obligations, and rights that the Company and Users must be sure to be aware of are as follows.

A. Responsibilities, Obligations, and Rights of All Users, Including Creators

• The Generative AI Content that a User produces must not infringe the rights of existing creators or works.
• The User has the obligation to review and comply with the Terms of Service, the Creator Terms and Conditions, and the service operation policies of this Service in generating and using AI Content, and the User shall bear sole responsibility for any legal and moral liability arising from failure to comply with them.
• The User is responsible for the Prompts that they write in order to produce Generative AI Content.
• Content produced with the AI Drawing and AI Studio provided by the tooldi Service must not cause offense to anyone.
• When becoming a Creator and uploading Generative AI Content, the Creator is responsible for copyright and other issues arising in connection with such uploaded content.
• When becoming a Creator and uploading Generative AI Content, the Creator has the obligation to be sure to disclose that the content is Generative AI Content.
• When posting or sharing content that includes AI Content (such as finished templates), you must check and review whether such content violates the Terms of Service, the Creator Terms and Conditions, or this Policy.
• In the case of Generative AI Content produced by a User, the source must be indicated with the User's own name, the name of the organization to which they belong, or the like, in order to disclose that it is content generated by the User.
• When used as a shared post, it must be indicated that the post is an output containing Generative AI Content. (See Article 6.)
• When sharing or posting content utilizing the AI Drawing and AI Studio functions provided by the Service, it must not be expressed in a manner that causes the content to be mistaken for an independent creative work made without the assistance of AI.

B. Responsibilities, Obligations, and Rights of the Company

• The Company may store and manage the AI Content you generate and the Prompts used in its generation in the Company's storage, such as a non-public image datalake.
• Use for the Purpose of AI Learning and Service Improvement: The Company may store, use, and utilize for learning the Prompts written by Users and the generated outputs, within the scope below.
• Prompts: Storage, analysis, and learning for the purpose of improving service quality and the performance of AI functions.
• Generated Outputs: Storage, reuse, and learning for the purpose of operating and improving the Service and advancing AI functions.
• The above use is limited to the purpose of providing and improving the Service and advancing AI functions, and the Company does not sell or provide the original Prompts or generated outputs to any unrelated third party.
• The User must take care not to enter into Prompts any sensitive information, such as the personal information or identifying information of others, and where such information is included, the Company shall process it in accordance with the Privacy Policy.
• Where the Company determines that AI Content you have generated has value for use as public content, it may provide it within the Service. Even in such a case, the copyright in such content shall belong to the creator in accordance with Article 5, and the Company provides it within the scope of a non-exclusive license. (The revenue and settlement of Creator Content shall be governed by the Creator Terms and Conditions and the Content License Policy.)
• The Company shall continuously update this Policy with the latest content so that Generative AI Content and related functions may be properly utilized, and where it amends the Policy, it shall specify the reason and the date of application and give notice before the effective date through a service announcement or through the email, messenger, or other channel registered by the User. In the case of a change that is unfavorable or material to the User, the Company shall give notice from thirty (30) days prior to the effective date.
• The Company may apply differentiated limits on the number of uses of AI-related functions or the number of generated content items according to the level of the paid service.
• Where the Company wishes to use a User's Generative AI Content for the purpose of service promotion or marketing, the Company shall obtain separate consent from the User in accordance with relevant laws and regulations.

8Please Be Sure to Remember When Utilizing AI Content!

We hope that AI Content will have a positive influence on the world. Therefore, when producing or uploading AI Content, please be sure to remember the following.

A. When Utilizing for Design Creation

• AI Content must not include content that exploits children or adolescents or depicts them as sexual objects.
• Do not reproduce or produce in similar form a specific person or phenomenon for the purpose of causing social division.
• Content related to crime or content that induces illegality must not be included.
• Obscene or salacious content must not be included.
• Do not produce content for the purpose of disparaging a specific group politically or socially.
• Do not produce content that arouses religious antipathy.
• Do not produce content for the purpose of damaging the reputation of, insulting, or defaming another person.
• Do not produce content for the purpose of damaging the reputation of, insulting, or defaming a specific group.
• Do not produce content for the purpose of disparaging or discriminating against a specific group, or promoting discrimination.
• Do not produce content that disparages, or may cause psychological harm based on, characteristics such as age or gender.
• Do not produce content that violates or infringes copyright or intellectual property rights, such as a specific company's trademark rights, logo, or CI.
• Do not produce content that violates or infringes the portrait rights, personal information, or publicity rights of others.
• Do not produce content in the form of fake news.
• Do not produce content that presents medical advice or that may be interpreted as content regarding medical outcomes.
• Do not produce other content that may cause offense to others.

B. When Utilizing for Creator Uploads

• Be sure to comply with the contents of Section 8-A of this Policy.
• When uploading Generative AI Content, be sure to designate the category as AI Content.
• Upload only AI Content that you generated or created by writing the Prompt yourself.
• Do not repeatedly upload AI Content for which there exists a clear ground for rejection.

C. Prohibitions and Compliance Matters Regarding Deepfakes and Synthesis of Persons

When synthesizing a person's face, body, voice, etc. with generative AI, you must be sure to observe the following, for the sake of the rights of others and social safety.

• (Absolutely Prohibited) Sexual False Videos: Regardless of whether the subject is a child or adolescent, the act of producing, uploading, or distributing deepfakes (such as false videos) that target a person and induce sexual shame or disgust is absolutely prohibited. (Act on Special Cases Concerning the Punishment of Sexual Crimes Article 14-2, etc.)
• (Absolutely Prohibited) Synthesis of Real Persons Without Consent: The act of synthesizing the face, voice, etc. of an actual person, including celebrities and public figures, without that person's explicit consent, thereby infringing portrait rights, publicity rights, reputation, or the like, is prohibited.
• (Absolutely Prohibited) Election/Political Manipulation and Impersonation: The act of producing or disseminating deepfakes intended to influence an election, or deepfakes that impersonate a specific person or institution or cause false facts to be mistaken as true (such as fake persons or fake announcements), is prohibited. (Public Official Election Act; Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.)
• (Conditionally Permitted) Oneself, Consented Persons, or Virtual Persons: This is permitted only where the subject is oneself or a person who has given explicit consent, or a virtual person or character that manifestly does not actually exist; and even in such a case, the fact of AI generation and deepfake must be clearly indicated in accordance with Article 6.

9Measures Upon Violation and Reporting

• Reporting: If you discover content that violates this Policy, you may report it through the reporting function within the Service or through customer service.
• Measures by the Company: The Company may take measures such as restricting or deleting the posting of content that violates this Policy, and where the degree of the violation is severe or repeated, it may restrict use of the Service in accordance with the relevant terms and policies. However, the Company shall take such measures in accordance with legitimate grounds and procedures, and shall endeavor to provide prior notice and an opportunity to explain where necessary.
• Cooperation with Investigative Authorities: For content that clearly constitutes a crime, such as deepfake sexual false videos, the Company shall immediately take necessary measures such as deletion, and may cooperate with investigative authorities and others in accordance with the relevant laws and regulations.

10The Company's Disclaimer Regarding Generative AI Content

• Because Generative AI Content is generated by artificial intelligence, the Company does not guarantee the accuracy or representativeness of the AI Content generated or utilized throughout the tooldi Service.
• Except where expressly provided, the Company provides no separate warranty or guarantee regarding Generative AI Content.
• Where a User or Creator faces an infringement of rights or a copyright dispute from a third party due to a finished template created using Generative AI Content, the User or Creator must resolve it at their own cost and responsibility.
• Responsibility for problems or disputes arising from a Creator's use or upload of another company's Generative AI Content lies with the User who used or uploaded such content.
• Notwithstanding each of the foregoing paragraphs, however, the Company shall bear liability in accordance with the relevant laws and regulations for any damage arising from the Company's intent or gross negligence.
